By downloading or using Onda Replay, you agree to these Terms.

1. The Service

Onda Replay is a private audio capture and transcription app, available on iOS and Android. Your recordings are stored only on your device. ONDA does not store, sync, or have access to your audio files unless you choose to publish them (see Section 4, Publishing).

Your recordings belong to you. ONDA does not claim ownership of, or control over, copyright in your content.

When you delete a recording from the App, it is deleted from your device.

2. Free Use — Recording and Transcription

Recording is free and unlimited. Onda Replay is designed to be a full, real tool for personal and family use at no cost — recording, editing, and organizing your own material for yourself, your family, and your friends, with no subscription required, as long as that content stays private to you.

When you choose to transcribe a recording, a short audio clip is sent to OpenAI Whisper for processing and deleted from their servers immediately after. Nothing is sent automatically — transcription only happens when you initiate it.

The free tier includes approximately 60 minutes of transcription per calendar month, resetting on the first of each month.

Additional transcription beyond the free monthly amount can be added a la carte ("Jerry Can" top-ups). A monthly subscription offers an additional 5 hours of transcription (see Section 3) plus a la carte purchases.

3. Subscriptions

Onda Replay offers two paid subscription tiers:

Contributor — $8.99/month. Includes an additional 5 hours of monthly transcription; further a la carte / 5-hour purchases are also available. A Contributor subscription allows you to submit your recordings to a Curator's station for possible publication on ONDA Nile, at a Curator's discretion. A Contributor cannot publish directly to ONDA Nile — only a Curator can publish content to Nile, including a Curator's own work or a Contributor's submission to that Curator. Selling your own files independently — on Etsy, your own site, or anywhere else — is always free and never requires a subscription. ONDA is not involved in and has no restrictions on private sales. Display of content on the ONDA Player does not imply approval of that content.

Curator — $19.99/month. Includes everything in Contributor, plus the ability to host a public "station" on ONDA Nile and publish content to it — your own work, or a Contributor's submission you've reviewed and approved. Nothing published on ONDA Nile itself is ever gated or paywalled — everything on Nile is free for anyone to consume. Like a Contributor, a Curator may separately sell access to their own proprietary content or services through their own website or other channels, entirely outside of ONDA Nile; ONDA is not involved in and has no restrictions on those independent sales.

If a Curator publishes content that violates these Terms — including content that is not from a real human, or that constitutes hate speech or otherwise violates community standards — ONDA may bar that Curator, who forfeits their subscription and their station. This can end distribution for Contributors who had legitimate content published under that station, even though they did nothing wrong; those Contributors are free to seek a different Curator.

A Contributor whose content was published by a barred Curator receives a formal warning on their own record — not a loss of privileges. If that same Contributor is later published by a second Curator who also gets barred, that repeated pattern may result in loss of the Contributor's own publishing privileges.

Billing: Charged to your Apple ID or Google Play account at purchase confirmation. Auto-renewal: Renews monthly unless cancelled at least 24 hours before the end of the current period. Cancellation: Manage or cancel in your Apple ID or Google Play (when available) account settings at any time. Refunds: We do not offer refunds for partial subscription periods. Apple's and Google's payment terms apply to all transactions made through their respective stores. ONDA does not have access to your payment information.

4. Your Content

Recording and editing are always free and private by default. Publishing a recording to ONDA Nile — making it reachable by anyone beyond your own private use — only happens through a Curator: either a Curator publishing their own work, or a Curator reviewing and approving a Contributor's submission. An active Curator subscription (and, for a submitted recording, an active Contributor subscription from whoever submitted it) is required to establish identity and limit or prevent AI or robotic participation.

Your published content remains yours. ONDA does not claim ownership of, or copyright in, anything you publish. By publishing, you grant ONDA the right to host, display, and make your content available through ONDA Nile for as long as your subscription (or the subscription of the Curator whose station hosts it) maintains an active subscription.

ONDA reserves the right to remove any published content that violates these Terms, infringes on the rights of others, or is otherwise reported and found to violate applicable law, at ONDA's sole discretion.

If your subscription lapses, or the subscription of the Curator whose station hosts your published content lapses, ONDA may, at its discretion, keep that content live for a period of time before it is removed from public view. This is offered as a courtesy and is not a guaranteed period — you should not rely on published content remaining available after a subscription lapses.

A fully downloaded .onda file already saved to your own device is yours to keep permanently and is not affected by any subscription status, published or not.

Your recordings belong to you, whether private or published. When you delete a recording from the App, it is deleted from your device. Deleting a published recording, or downgrading/cancelling a subscription that a published recording depends on, removes it from public availability on ONDA Nile per this Section.

5. Consent to Record

You agree not to use the App to record conversations without the consent of all parties where required by law. Recording laws vary by location — you are responsible for knowing and following the laws in your jurisdiction. This applies whether or not you intend to publish the recording.

6. Privacy

Your use of Onda Replay is also governed by our Privacy Policy at ondalist.com/privacy, incorporated into these Terms by reference.

7. Disclaimer

The App is provided "as is" without warranties of any kind. We do not guarantee uninterrupted service, error-free transcription, or that the App will meet your specific requirements.

8. Limitation of Liability

To the fullest extent permitted by law, ONDA shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
